Welcome to liftups.
These Terms of Service (“Terms”) govern your access to and use of our website, platform, and services (collectively, the “Platform”). By creating an account or using the Platform, you agree to these Terms.

1. Overview of the Platform

Our Platform allows users (“Posters”) to list temporary, small, one-time tasks (“Jobs”) and allows other users (“Workers”) to accept and complete those tasks for payment. We only provide the online platform; we are not a party to any Job, and we do not supervise, direct, or control Workers.

2. No Employment Relationship

You understand and agree that:

  • Workers are independent contractors, not employees, agents, or representatives of the Company.
  • The Company does not hire, fire, supervise, train, or manage Workers.
  • Posters are not hiring employees and must comply with all applicable labor laws.

You agree not to classify or treat any Worker as your employee.

3. Payments & Fees

After a Job is completed:

  • The Poster pays the agreed amount through the Platform.
  • The Worker receives approximately 88% of the Job payment.
  • The Company retains the remaining percentage as a service fee.

Payments made outside the Platform are strictly prohibited.

4. User Responsibilities

4.1 Posters

Posters agree to:

  • Post only lawful, safe, and non-hazardous Jobs
  • Provide accurate instructions and compensation
  • Comply with all local, state, and federal laws
  • Not request any task involving illegal activity, violence, safety risks, or property access that violates law

4.2 Workers

Workers agree to:

  • Perform Jobs in a safe, lawful manner
  • Use their own tools, equipment, and transportation
  • Be fully responsible for their own actions during a Job
  • Not engage in illegal activity, trespassing, or unsafe conduct

5. No Liability for User Actions

YOU AGREE THAT THE COMPANY IS NOT RESPONSIBLE OR LIABLE FOR:

  • Any actions, behavior, or conduct of Workers or Posters
  • Property damage, personal injury, or theft
  • Misrepresentations, illegal acts, or negligence by users
  • The outcome, quality, or completion of any Job

All interactions between users are solely at your own risk.

6. Assumption of Risk

By using the Platform, you acknowledge and agree that interacting with strangers, performing or posting Jobs, and entering private property all carry inherent risks.
You assume all risks associated with using the Platform.

7. Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against all claims, liabilities, losses, damages, and expenses (including attorneys’ fees) arising from:

  • Your use of the Platform
  • Your participation in any Job
  • Your conduct, actions, or omissions
  • Violations of these Terms
  • Damages caused to persons or property

This section protects the Company if someone tries to sue because of something you did.

8. No Guarantee or Screening

We do not guarantee:

  • The background, skill, identity, or safety of any user
  • That a Job will be completed
  • That a Worker or Poster is reliable
  • That payment or performance will occur

Users must conduct their own due diligence.

9. Prohibited Activities

Users may NOT use the Platform for:

  • Illegal activities
  • Dangerous or hazardous tasks
  • Violent or harmful conduct
  • Discriminatory or abusive behavior
  • Fraud, scams, or payment evasion
  • Posting Jobs involving minors or vulnerable individuals
  • Jobs requiring professional licenses without proof

We may remove any Job or user at our discretion.

10. Dispute Resolution

The Company is not responsible for disputes between Posters and Workers.
Users agree to resolve disputes directly between themselves.

11. Account Termination

We may suspend or terminate accounts for:

  • Safety concerns
  • Violations of law
  • Repeated complaints
  • Abuse of the Platform
  • Fraud or payment manipulation

12. Disclaimer of Warranties

The Platform is provided “as-is” and “as available” without any warranties, express or implied.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY:

  • Damages
  • Loss of income
  • Property losses
  • Injuries
  • Incidents involving Workers or Posters
  • Misuse or inability to use the Platform

Your sole remedy is to stop using the Platform.

14. Governing Law

These Terms are governed by the laws of [Your State / Country], excluding its conflict-of-law rules.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Platform means you accept the updated Terms.

These Worker Terms (“Terms”) apply to individuals (“Workers”) who register on [Your Site Name] (“Company,” “we,” “our,” “us”) to perform one-time tasks (“Jobs”) posted by other users (“Posters”).
By signing up as a Worker, you agree to the following:

1. Independent Contractor Status

You acknowledge and agree that:

  • You are an independent contractor, not an employee, agent, representative, partner, or joint venture of the Company.
  • The Company does not control how, when, or where you perform Jobs.
  • You supply your own tools, equipment, and transportation.
  • You are responsible for your own taxes, insurance, and licenses.

You will not claim employee benefits, workers’ compensation, unemployment, or wages from the Company.

2. Worker Responsibilities

You agree to:

  • Perform all Jobs safely, professionally, and legally
  • Follow all applicable local, state, and federal laws
  • Avoid illegal activities, unsafe conduct, trespassing, or entering restricted property
  • Use your own judgment and refuse Jobs that are unsafe or unreasonable
  • Provide truthful information about your identity and qualifications
  • Not harass, threaten, or harm Posters or other users

You are fully responsible for your actions during any Job.

3. Payment & Service Fees

  • Payments must be made through the Platform only.
  • Workers receive approximately 88% of the Job payment.
  • The Company keeps a service fee from each completed Job.
  • You must not attempt to receive payments outside the Platform.

The Company is not responsible for tax reporting or tax withholding.

4. No Guarantee of Jobs

The Company does not guarantee:

  • That you will receive any Jobs
  • Continuous work
  • A minimum number of tasks
  • Income or earnings
  • That Posters will choose you for a Job

You understand this is not an employment system.

5. Assumption of Risk

By performing Jobs, you acknowledge and understand that:

  • Tasks may involve risk
  • Interacting with unknown individuals carries potential danger
  • Entering private property may involve hazards
  • You assume all risks associated with performing Jobs
  • The Company does not screen or verify Posters or job details

You voluntarily assume all risks associated with accepting and performing Jobs.

6. No Liability by the Company

To the fullest extent permitted by law, the Company is not liable for:

  • Injuries, damages, or losses you suffer while performing a Job
  • Misconduct, negligence, or illegal actions by Posters
  • Property damage
  • Disputes over payment, instructions, or job quality
  • Unsafe conditions or inaccurate information provided by Posters

Your sole recourse for disputes is to resolve them directly with the Poster.

7. Indemnification

You agree to defend, indemnify, and hold the Company harmless from all claims, damages, losses, injuries, or legal actions arising out of:

  • Your performance of a Job
  • Your actions or omissions
  • Property damage or personal injury caused by you
  • Violations of law
  • Violations of these Terms
  • Misuse of the Platform

If someone sues the Company because of something you did, you are responsible, not the Company.

8. Prohibited Jobs & Conduct

Workers may NOT:

  • Perform illegal activities
  • Handle hazardous materials
  • Enter unsafe or restricted areas
  • Perform tasks requiring professional licenses without possessing them
  • Engage in harassment or violence
  • Access areas of a Poster’s property not related to the job
  • Accept jobs involving minors or vulnerable individuals

We may ban or suspend any Worker who violates these rules.

9. Tools, Equipment, & Safety

Workers are responsible for:

  • Providing their own tools
  • Ensuring they are competent and trained to use them
  • Wearing appropriate safety gear
  • Refusing jobs they consider unsafe

The Company does not provide equipment, training, or safety guarantees.

10. Account Termination

We may suspend or terminate a Worker’s account for:

  • Unsafe behavior
  • Violations of law
  • Dishonesty or fraud
  • Payment manipulation
  • Repeated complaints
  • Posting or accepting prohibited Jobs

11. Dispute Resolution

Disputes between Posters and Workers are strictly between those users.
The Company does not mediate or resolve user disputes.

12. Governing Law

These Terms are governed by the laws of New Hampshire.

13. Acceptance of Worker Terms

By registering as a Worker, you acknowledge you have:

  • Read and understood these Terms
  • Agreed to all conditions and responsibilities
  • Accepted independent contractor status
  • Assumed all risks associated with performing Jobs
